1. Introduction

Welcome to Fit-Connect ("we," "our," or "us"). These Terms of Use ("Terms") govern your access to and use of the Fit-Connect website, mobile application, and related services, products, and marketplace (collectively, the "Platform").

By accessing or using Fit-Connect, you agree to be bound by these Terms, all applicable laws and regulations, and agree that you are responsible for compliance with any local laws. If you do not agree with these Terms, you are prohibited from using or accessing the Platform.

All materials on Fit-Connect are protected by applicable intellectual property laws, including copyright and trademark law.

2. Use License

Permission is granted to temporarily download one copy of any downloadable materials on Fit-Connect for personal, non-commercial, transitory viewing only. This is a grant of license, not a transfer of title. Under this license, you may not:

• Modify or copy the materials;
• Use the materials for any commercial purpose or public display (commercial or non-commercial);
• Attempt to decompile or reverse-engineer any software on the Platform;
• Remove any copyright or proprietary notations from the materials; or

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Fit-Connect at any time. Upon termination, you must destroy any downloaded materials in your possession, whether electronic or printed.

To access certain features, you may be required to register and create a Fit-Connect account. You agree to:

• Provide accurate, current, and complete information;
• Maintain the confidentiality of your login credentials; and
• Accept responsibility for all activities under your account.

We reserve the right to suspend or terminate any account that violates these Terms or any applicable law.

4. Marketplace Services

Fit-Connect functions as a platform and marketplace connecting fitness professionals, coaches, studios, and wellness providers ("Vendors") with users seeking training or wellness services ("Users").

Fit-Connect acts solely as an intermediary. Any agreements, transactions, or interactions between Vendors and Users are made directly between those parties. Fit-Connect is not a contracting party to such arrangements.

Vendors are solely responsible for:

• The accuracy of their listings and content;
• Compliance with applicable laws and professional regulations;
• Delivery and quality of their services.

Fit-Connect does not guarantee or endorse the quality, legality, or reliability of services offered on the Platform.

5. Payments and Fees

Payments made via Fit-Connect may be processed by third-party payment providers under secure, encrypted protocols. By making a purchase, you authorize us or our partners to process charges on your chosen payment method for the full amount due, including any applicable taxes or service fees.

All transactions are subject to the relevant Vendor's cancellation and refund policy. Fit-Connect is not responsible for Vendor payment disputes, failed transactions, or service issues.

6. User Obligations

When using Fit-Connect, you agree to:

• Use the Platform lawfully and only for its intended purposes;
• Not upload or distribute any unlawful, defamatory, or harmful content;
• Not interfere with or disrupt the Platform's functionality or security;
• Not engage in fraudulent, deceptive, or abusive activity.

Violation of these obligations may result in suspension or permanent termination of your account.

7. Intellectual Property Rights

All content available on Fit-Connect — including but not limited to text, graphics, logos, icons, software, and data compilations — is the property of Fit-Connect or its licensors and protected by copyright, trademark, and other applicable laws.

You may not reproduce, copy, modify, or distribute any material without express written consent from Fit-Connect.

8. User-Generated Content

By posting or submitting any content (such as reviews, comments, photos, or listings), you grant Fit-Connect a non-exclusive, royalty-free, worldwide, perpetual license to use, display, and distribute such content to operate, promote, and improve the Platform.

You represent and warrant that:

• You own or have permission to post the content; and
• Your content does not infringe any third-party rights or violate any laws.

Fit-Connect reserves the right to remove or moderate content that breaches these Terms or is otherwise inappropriate.

9. Disclaimer

The materials and services on Fit-Connect are provided "as is." Fit-Connect makes no warranties, expressed or implied, and disclaims all other warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement of intellectual property rights.

We do not warrant that:

• The Platform will operate uninterrupted or error-free;
• The materials or information provided are accurate, complete, or current; or
• Linked third-party websites are safe, reliable, or compliant.

Use of the Platform is at your own risk.

10. Limitation of Liability

In no event shall Fit-Connect or its affiliates be liable for any damages (including, without limitation, damages for loss of data, revenue, or business interruption) arising out of the use or inability to use the Platform, even if we have been notified of the possibility of such damage.

Because some jurisdictions do not allow the exclusion or limitation of liability for consequential or incidental damages, these limitations may not apply to you.

11. Revisions and Errata

The materials appearing on Fit-Connect may include technical, typographical, or photographic errors. We do not warrant that any of the materials are accurate, complete, or current. Fit-Connect may change the materials on its Platform at any time without notice.

12. Links to Third-Party Sites

Fit-Connect has not reviewed all sites linked to its Platform and is not responsible for the content of any linked sites. The inclusion of any link does not imply endorsement by Fit-Connect. Use of any linked website is at the User's own risk.

13. Data Protection

Your personal data is collected and processed in accordance with our Privacy Policy and Cookie Policy, which comply with the General Data Protection Regulation (GDPR) and other applicable privacy laws.

14. Termination

Fit-Connect reserves the right to suspend or terminate your access to the Platform, without prior notice, if you violate these Terms or engage in behavior deemed harmful to the Platform or its Users.

Upon termination, you must cease all use of the Platform and destroy any materials obtained from it.

16. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Belgium, without regard to conflict of law principles.

Any disputes arising under these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Brussels.
